What is a Housing Co-op, Anyway?

Housing Cooperatives are a legal entity that owns real estate, with tenants being shareholders, paying their share of the associated fees. Individual shareholders do not own the real estate they live in, but are essentially shareholders of a corporation that owns real estate. Housing co-ops can take on a variety of forms.They can be one house, with tenants occupying a bedroom and sharing things like a kitchen and common-rooms, or they can be multiple residences similar to a condo or town homes, with each tenant occupying a residence. The former is most common among students, with co-op housing resembling a dorm-type situation, whereas the latter is common for single adults and families in urban settings.

The advantages of being a co-op shareholder are that you have much more control over your living space than if you were simply a tenant in an apartment that someone else owned. Also, they allow the sense of ownership to people who would normally have trouble getting a mortgage loan, as the cooperative itself, as a legal entity, can carry a mortgage. This makes it different from condominium ownership, where each tenant is responsible for their own funding. Another advantage is that co-op members share the real estate taxes. However, sometimes seen as a downside, co-ops do have occupancy agreements, and a shareholders occupancy must adhere to these rules. This agreement, essentially a lease, also dictates who a shareholder can rent or sell to, or even if they can sublet their unit at all. All co-op shareholders are part of the co-operative association, and have the option to serve on the board of directors which is usually a voluntary position (unpaid). The advantage of this is that they can co-create what the tenancy agreement consists of, and therefore have more control over their living situation.

The board of directors serves as a governing body, and in smaller co-ops can consist of all shareholders. In larger co-ops it isn’t uncommon for the task to rotate on a yearly or bi-yearly basis, with members being elected by all the shareholders at an annual general meeting. Usually, a Co-op will hire a manager who will then hire contractors to carry out necessary services.

While some people just love co-op housing, others find it stressful to adhere to the tenancy agreement’s guidelines. For example, there is a case of a mother moving out and leaving her young-adult daughter in her co-op home, only to have the other members consider her lease void. In other cases, judges have ruled that the children of shareholders had the right to stay in their homes.

If you are considering buying into co-operative housing, look over the tenancy agreement carefully. Consider getting to know some of the shareholders ahead of time, and asking them what they like and dislike about the arrangement. Every tenancy situation, including owning your own real estate, has its challenges and rewards. The important thing is finding something that suits your unique needs.

Your mortgage is probably the single largest financial obligation that you will have in your life. The investment that you have in your home can have great long term value, but on a month by month basis it represents a significant expense. The math for most people is simple, the more you pay on your mortgage, the less you have to spend on other things.

To underline this point it might be of interest to note that in 1980 the average person spent 25% of their gross monthly income on housing expenses. By 2005 that percentage had risen to over 43%. This is not really a surprise. We are all aware that home prices have risen significantly during this period of time. Income levels have not kept up with home prices and as a result home buyers are finding more of their paycheck going towards their mortgage payment.

Florida mortgage holders have acutely felt the impact as home prices in recent years have rivaled those of California. Your mortgage may consume more or less than the average 43% of your gross monthly income, but it is probably safe to say that it deserves to be intelligently managed.

To Refinance or Not to Refinance

Request a Good Faith Estimate. Make sure that your mortgage broker includes all third party charges and statutory costs along with the lender fees. It is equally important to consider your personal goals; how long will be in the home? Do you plan to retire soon? What type of personal saving plans do you have? What is your aversion to risk? Is an adjustable rate mortgage suitable?

Fixed or Adjustable

Fixed rate mortgages are pretty easy to understand. Adjustable rate mortgages on the other hand can be surprisingly complex. And there are literally thousands of variations of adjustable rate mortgages. Over the last five years negative amortization adjustable rate mortgages have become popular. Florida mortgage borrowers have embraced these programs for the advertised low payment rates. But these loans are complex; I believe that very few people that get this type of mortgage understand them. I also believe that there are mortgage brokers actively selling these programs that do not understand them.

Please take your time. Ask lots of questions. Take notes. Ask more questions. Make sure you understand the index, the margin, the adjustment period for both the note and the payment. It wouldn’t hurt to look at the worst case scenario. Can you live with it? If your mortgage broker can’t answer your questions find a new mortgage broker. Your financial life may depend on it.

How About a 15 Year Fixed?

There was a time when the interest rate on a 15 year fixed rate mortgage was consistently and significantly lower than the rate on a 30 year fixed rate mortgage. Between June of 2004 and June of 2006 the Federal Reserve increased the Federal Funds rate 17 times. This rate directly impacts all short term interest rates such as the Prime Rate. During the same period of time the long term rates remained more or less steady. The net effect was to close the gap between rates on shorter term mortgages like the 15 year fixed and longer term mortgages like the 30 year fixed.

At the time of this writing the rates on these two loan products happen to be exactly the same. But this should not take the 15 year fixed rate mortgage out of contention. For many people it is an excellent option. And it can still save lots of money.

For example, the payment on a 30 year fixed rate mortgage for $100,000 at 6% is $599.55. The payment on a 15 year fixed rate mortgage for $100,000 at 6% is $843.85. That is an extra $244.30 per month on the 15 year mortgage. But consider that the total payments made on the 30 year loan would be $215,838, versus $151,893 on the 15 year mortgage. By choosing the 15 year mortgage you would save $63,945. And you get to stop making mortgage payment in 15 years!

Interest Only

Given the high cost of homes it is no surprise that interest only programs have become so popular. Florida mortgage customers have flocked to these programs to make increasingly expensive homes affordable. An interest only mortgage can be appropriate if your sole concern is cash flow. During the interest only period you will not be paying any principle off. There are many types of interest only mortgage programs. The majority of interest only mortgage programs are “fixed period adjustable rate mortgages”. This means that they are fixed for a limited period of time; typically 3, 5, 7, or 10 years.

The interest only period usually corresponds to the fixed rate period. Once the fixed rate period ends the mortgage becomes adjustable. A new version of the interest only mortgage worth considering is the 30 year fixed rate mortgage with a 10 year interest only period. You get the benefits of the low interest only payment for 10 years - but with no adjustable rate risk waiting for you at the end of the interest only period.

Mortgage Loan Modification Assistance - How to Modify My Loan

The home loan industry has changed stated income loans requirements if you don’t know yet. Most lenders now want full documentation loans and borrowers qualifying by using traditional debt to income ratio calculations. This directly affects the high cost housing markets like California, Florida, and the tri-state area of New York, New Jersey, Connecticut as well as parts of Maryland, Virginia, and Massachusetts. When you are facing this situation and getting nowhere with a business and you don’t get the results you need in a timely manner, you should hire an attorney who specializes in foreclosures and loan modifications!

There are many stories from borrowers who say they most banks will not discuss your situation unless you are behind two to four months in payments. Once that occurs, your hard earned credit scores from years of being responsible are wiped out. Furthermore, you may never be eligible for a home loan at market rates for quite some time. The solution is to use a Loan Modification company that actually does have an attorney on staff to get answers and responses quickly so your situation is resolved quickly. You end up keeping your home, getting a loan modification, reducing your interest rate to an affordable level, and in some cases reducing your loan principal but there’s no guarantees. An experienced debt representative from the attorney backed loan modification company will call you to see if you do qualify based on certain criteria. Although, some firms will take your money and you don’t qualify. Those are the ones you have to watch out for. They hit you when you’re down. Work with a company that has success, years of experience, paralegals and an attorney on staff. You will feel more at ease knowing you have the best team working on a solution for you whether it be a short sale, a deed in lieu of foreclosure, tax ramifications of short sale, or a loan modification.

A lawyer who specializes in negotiating with lenders can achieve magical results especially if they find RESPA or TILA violations to use for leverage. A real estate attorney understands how to speak their language and get the lender to negotiate. When a homeowners uses an Attorney, the lender’s loss mitigation and legal department become very receptive and responsive. Get a good legal team on your side to stop foreclosure and get a loan modification!
